CDA - General Points
Defining criminal activity is difficult
Evidence is hard to produce
Legal counsel is invaluable
Legal notion of “property” extended to include data
No definition of “computer”
Computer areas are untested
Damage of data: add to, alter, corrupt, erase or move or any act that contributes to the above.
Notes:
Too may possibilities to have useable legal wording of each possible offence. Govt’s tend not to have expertise in the area.
Result is a broad (and consequently vague) wording.
Evidence that can be relied on in Court is hard to produce. Intruder will usually remove most or all traces
CERT recommend contacting legal counsel first. Consult even now.
