Exceptions
- security of the State
- must be available by law/court order
- kept by individual for family affairs/recreational purposes
- required urgently to prevent injury or serious loss/damage
- held or processed outside the State
Notes:
Is the computerised information only provision a loophole? The ease of processing means it required the legislation, but at the expense of controlling non-computerised information?
Personal data: must be living (not dead), individual (not a company) and identifiable.
Security: opinion of Minister Defense/Justice, senior garda/army officer.
DPC can issue a prohibition notice to prevent export of information out of the State.
